1. About Cardabra

Cardabra (“we”, “us”, “our”) is a tool based in New Zealand that helps you identify, price, and create listings for Pokémon trading cards on your own Trade Me account. By using Cardabra you agree to these Terms.

2. Eligibility

You must be at least 18 years old, have a valid Trade Me account, and be able to form a binding contract. You are responsible for all activity under your account.

3. Relationship with Trade Me

Cardabra is independent and is not affiliated with, endorsed by, or operated by Trade Me Limited. You authorise Cardabra to access your Trade Me account to create and manage listings on your behalf. You remain responsible for complying with Trade Me’s own terms and policies, including the requirement that listing tools are intended for in-trade (registered business) sellers. If your account is not an in-trade seller, you use Cardabra at your own risk.

4. The service is assistive, not authoritative

Card identification and pricing are generated automatically (including AI image matching and third-party price data) and are estimates provided “as is”. They may be inaccurate. You must review every draft — including the title, description, price, and photos — before listing. You are solely responsible for the content and legality of the listings you publish.

5. Acceptable use

You agree not to use Cardabra to list counterfeit, stolen, or prohibited items, to break any law, or to misuse the Trade Me terms and conditions. We may suspend or terminate accounts that do.

6. Subscription and payment

Access to Cardabra is provided on a recurring subscription basis ("Cardabra Plus") at NZ$4.99 per month, billed in advance. Prices shown are the total amount payable and are inclusive of GST. New subscriptions include a 7-day free trial; your payment card is collected at sign-up but not charged until the trial ends. The subscription renews automatically each month unless cancelled. Payments are processed by our payment provider, Stripe.

You can cancel at any time from the billing portal. Cancellation takes effect at the end of your current billing period, and you retain access until that date. Subscription fees, including the current month if you cancel partway through, are non-refundable to the extent permitted by law. If we discontinue the service, your subscription will cease and any unused portion of a paid period is non-refundable. Nothing in these Terms limits rights you may have under the Consumer Guarantees Act 1993.

7. Availability

Cardabra is provided on a best-effort basis and may be unavailable, interrupted, or changed at any time. We do not guarantee uptime.

8. Intellectual property

“Pokémon” and related marks are trademarks of their respective owners (Nintendo, Creatures Inc., GAME FREAK inc.); “Trade Me” is a trademark of Trade Me Limited. Cardabra is not affiliated with any of them. You retain ownership of photos you upload and grant us a licence to use them solely to provide the service to you.

9. Disclaimers and limitation of liability

To the maximum extent permitted by law, Cardabra is provided without warranties of any kind, and we are not liable for indirect or consequential loss, lost sales, mispricing, mis-identification, or actions taken by Trade Me against your account. To the extent permitted by law, our total liability to you is limited to the amount you paid us in the three months before the relevant claim.

10. Indemnity

You agree to indemnify us against claims, losses, and costs arising from your listings, your use of Cardabra, or your breach of these Terms or of Trade Me’s terms.

11. Termination

You may stop using Cardabra at any time. We may suspend or end your access for breach of these Terms. Unused credits are non-refundable on termination for breach.

12. Changes

We may update these Terms from time to time. Material changes will be notified in-app or by email.

13. Governing law

These Terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction.
